    Court Rejects NIMBY Appeal of Surprise Affordable Development

    The Arizona Court of Appeals has thrown out an appeal from opposition group Voice of Surprise that sought to stop Dominium Management’s master-planned affordable housing development Waddell Crossing.

    The group had filed a petition appealing the City Council’s approval of the development and calling for a referendum. The development will create standard affordable housing units, senior affordable housing units and a self-storage facility at Waddell Road and Cotton Lane.

    The petition had more than 5,000 signatures but was rejected by the City because it failed to comply with state law by not attaching a copy of the title and text of the ordinance it looked to challenge. Voice of Surprise filed the lawsuit after the rejection.

    Maricopa County Superior Court Judge Scott Blaney ruled in favor of Surprise. The group appealed to the Court of Appeals, which upheld Blaney’s ruling and dismissed the group’s various allegations in a ruling filed on Feb. 7.

    Voice of Surprise is now considering trying to recall the Mayor and City Council members who supported the proposal.

    A firm start date for the construction of Waddell Crossing has not been set, but Dominium representatives have said they hope to start work in the late summer or early fall. (Source)
