The Coconino Superior Court decided the site of the planned TownePlace Suites by Marriott at 2000 E. Route 66 in Flagstaff is to be auctioned off by the Coconino County Sheriff’s Office.
A total of 11 liens were placed against owner D Flag T LLC. Also named in the default judgment were defendants Akal Development Inc. and Jaspal Singh Sidhu. Auctioning the land will go toward settling the $105K notice and claim of lien filed by Geary Pacific Corporation.
Geary Pacific originally filed a civil lawsuit in September 2024, while its notice and claim of lien were filed in July of that year. The civil lawsuit is one of four filed against defendant D Flag T LLC.
Another civil lawsuit, with plaintiff Independent Electric Supply, was dismissed with prejudice against 12 defendants in January of this year. The remaining two civil lawsuits from Vanguard Builders AZ LLC and Premier Project Management LLC are pending. These lawsuits were filed to foreclose liens filed in 2024.
Premier Project Management is seeking a total of $70.2K. Vanguard is seeking $594K. The most recent lien, filed this February by Overland Construction Corporation, claims the company is owed $935K.
Court filing notes stated the project was officially completed on Oct. 11, 2024, due to an Arizona statute that claims projects are completed after 60 consecutive days of no labor. Labor for the project ended on Aug. 13, 2024.
The three defendants failed to respond after being served, which led to the order compelling the sale of the property. Other contractors and subcontractors filed liens or were named as codefendants, but only the three mentioned parties currently have judgments to pay. D Flag LLC, an affiliate of Galaxy Hotel Group, originally purchased the land from FLG Hospitality Inc. in 2021 for $2.4M.
D Flag LLC also owes Coconino County $18.1K in property taxes. An auction date for the property is unclear at this time. (Source)
